LakCloud (Pvt) Ltd (“LakCloud,” “we,” “our,” or “us”) is a premier provider of web hosting, website development, and SEO services. LakCloud operates alongside its associated brands and subsidiaries, including LibertyFusion Studios Ltd, Hosta. By accessing or using our website, products, and services, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, you may not use our services. By purchasing any of our products or services, you confirm that you are eligible to enter into this agreement (including but not limited to being at least 18 years of age and complying with the laws and regulations of your jurisdiction). You also acknowledge and agree that these Terms form a legally binding agreement between you and LakCloud.

Definitions

“Services” refers to the hosting, website development, SEO, and other related services provided by LakCloud. “Customer” or “User” refers to any individual or entity who accesses or uses our Services. “Agreement” refers to these Terms and any policies referenced herein.

Eligibility
By using our Services, you confirm that you are at least 18 years old or the legal age of majority in your jurisdiction and that you comply with all applicable laws and regulations. LakCloud reserves the right to verify your eligibility at any time.

Services
LakCloud provides its Services as outlined on our website and reserves the right to modify, suspend, or discontinue any Service at any time without notice. Service availability may be subject to scheduled maintenance or unforeseen outages. While we strive to minimize disruptions, uninterrupted service is not guaranteed.

User Responsibilities
Users are responsible for maintaining the confidentiality of their account credentials and for all activities under their account. Users must not use our Services to violate any applicable laws or regulations, transmit harmful or offensive content, engage in spamming or phishing, or host or distribute malware, viruses, or pirated content. LakCloud strictly prohibits the use of its products and services for drug trafficking, terrorism, modern slavery, child pornography, or any other illegal activities. By using our Services, you agree to refrain from engaging in or facilitating any of the aforementioned activities. Users are solely responsible for all data, content, and materials uploaded or hosted using our Services. LakCloud disclaims liability for any user-generated content.

Fees and Payments
All fees for our Services are listed on our website and are subject to change with prior notice. Users must pay for Services in advance unless otherwise specified. Accepted payment methods include credit/debit cards, bank transfers, and cryptocurrency. Late payments may incur additional fees, including a reactivation fee of $5.00 for suspended accounts. Refunds are governed by our Refund Policy. 

Late Payment, Suspension, and Data Retention (Web Hosting Services Only)
In the event of a late payment for web hosting services, the Client will be provided with a grace period of five (5) calendar days during which services will not be suspended. If payment is not received within this grace period, the hosting account may be suspended until full payment is made. The Client’s data will be retained on our servers for a maximum period of thirty (30) calendar days from the date of suspension. If payment is not received within this period, the Company reserves the right to permanently delete all data associated with the Client’s hosting account without further notice. The Client acknowledges and agrees that the Company shall not be held liable for any loss of data resulting from such deletion.

A grace period of five (5) calendar days is allowed for late payments. After this grace period, a late fee of ten percent (10%) of the outstanding amount will apply. In the event the hosting account is suspended, a flat late fee of ten percent (10%) of the outstanding balance will be charged before service restoration.

Intellectual Property
All content, trademarks, logos, and software provided by LakCloud remain our exclusive property. Users are granted a limited, non-exclusive, and revocable license to use our Services. Users must not copy, reproduce, or reverse-engineer any part of our Services without prior written consent.

Privacy
Our collection and use of personal information are governed by our Privacy Policy, which forms part of this Agreement.

Termination
LakCloud reserves the right to suspend or terminate Services if a User violates these Terms, engages in illegal or harmful activities, or fails to pay fees on time. Users may terminate their account by providing written notice to LakCloud. Termination does not exempt Users from outstanding payment obligations.

Limitation of Liability
To the fullest extent permitted by law, LakCloud (Pvt) Ltd, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of revenue, profits, data, or goodwill, arising from or related to the use of our Services. This limitation applies regardless of the legal theory under which liability is asserted, even if we have been advised of the possibility of such damages. Our total liability to you for any claims, damages, or losses shall not exceed the amount you paid to us for the specific Service giving rise to the claim.

Indemnification
Users agree to indemnify and hold LakCloud harmless from claims, damages, or losses arising from their use of our Services, violations of these Terms, or third-party claims related to their content.

Dispute Resolution
Parties agree to resolve disputes through good-faith discussions. If unresolved, disputes shall proceed to mediation with a neutral third party. Unresolved disputes shall be submitted to binding arbitration in Colombo, Sri Lanka, under Sri Lankan law. In the event arbitration fails, disputes may be brought before the courts of Sri Lanka.

Modifications to Terms
LakCloud reserves the right to update these Terms at any time without prior notice. Updates will be published on our website, and your continued use of our Services constitutes acceptance of the revised Terms.

Force Majeure
LakCloud shall not be held liable for delays or failures in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, cyberattacks, power outages, or technical interruptions caused by third-party providers. Such events shall relieve LakCloud of its obligations for the duration of the disruption.

Miscellaneous
These Terms constitute the entire agreement between the parties. If any provision is found invalid, the remaining provisions remain in effect. Failure to enforce any provision does not constitute a waiver of rights.
